Sex offender arrested after failing to register
BILLERICA, Mass. -- A local sex offender has been arrested again.
Ernest Frobese, a level-three sex offender, failed to register with police, which is required by the law.
"He had until November 8 to register, which time he didn't I applied for a warrant for his arrest and this morning he was arrested," said Sergeant Jerry Roche, of the Billerica Police Department.
For the past two years, 7News has caught Frobese handing out candy to children on Halloween.
According to Massachusetts law, it is not illegal for a convicted sex offender to hand out candy on Halloween. However, Billerica police say that they are doing what they can to limit Frobese's exposure to kids.
"Frankly, he shouldn't be handing out candy to kids," Sergeant Roche said. "You think that would be common sense, so he does these and he pushes the limits of the system."
Frobese will be arraigned at Lowell District Court Tuesday morning. If convicted, he could face up to five-years in jail.
