Man held without bail after hitting boy with car

DARTMOUTH, Mass. (WHDH) -- A man is accused of backing a car out of a driveway at a high rate of speed, crashing through a fence and hitting a 4-year-old boy.

“It was fast, it was fast,” said Edward Rebello, the boy’s grandfather.

"You never think that a car's going to come into your yard and hit your children," said Tammy Rebello, the boy's grandmother.

Edward Rebello recounted how the 4 year old could have died in his own backyard.

“He was playing in the yard and I guess the guy just did a whole u-turn right into the fence, ran him over,” said Edward Rebello.

Cole Kelley has tire marks on his legs, his back and the left side of his body.

“The mother was right there, she grabbed him within a couple -- probably a minute, you know,” said Edward Rebello.

"He's a little traumatized. To go through something like that -- he's really nervous about vehicles. We had a hard time getting him into our Jeep earlier," Tammy Rebello said. "He has a lot of road rash, complaining about leg pain. He has a lot of bruising on his back."

Pedro Roias was in court Thursday and charged with driving drunk and a slew of other charges related to the accident.

Roias’ landlord said he had two flat tires and had been drinking vodka all day.

“Pedro put in the gas in the car, the car go fast, breaking the gate to my neighbor,” said Maria Santos, the suspect’s landlord.

Cole was taken to Hasbro Hospital in Providence and was released Wednesday night.

On Thursday, police were back at the scene collecting evidence, including Cole’s shorts that he was wearing at the time. Meanwhile his family cleaned up the shattered fence.

“He’s doing good. He’s hanging in there. He’s a tough kid, he’ll be alright,” said Edward Rebello.

"Cole loves Pedro. He does. They play at the gate, he sings to him, plays with him," Tammy Rebello said.

Roias was held without bail. He has a dangerousness hearing scheduled for Friday.
