Closing arguments wrap up in NJ 'fat defense' case

HACKENSACK, N.J. -- Closing arguments have wrapped up in the New Jersey murder case against a Florida man who claims he was too fat to have killed his former son-in-law.

Lawyers finished closing statements Wednesday and expect the case to go to jurors by late the next afternoon.

Edward Ates' lawyer told jurors all they have to do is look at his client to see he's obese, old and in no condition to have killed Paul Duncsak in 2006.

Prosecutors agree Ates can't run a marathon. But they say he was still capable of planning and carrying out the killing.

The son-in-law was embroiled in a bitter custody dispute after divorcing Ates' daughter.
